This warranty is limited to customers residing in Canada.
ANY IMPLIED WARRANTIES ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Warranty Coverage
CVN Technologies Inc. provides warranty coverage as described below and limited to the terms and conditions hereof. CVN Technologies Inc. hereby provides a limited non-transferable Product Warranty from the date of purchase of the subject Product against defects in Product materials or workmanship.
This warranty is offered only on refurbished electronics and goods sold by CVN Technologies Inc., purchased and used in Canada by the consumer. A Proof of Purchase may be required. The Warranty Period commences on the date of Product purchase and ceases on the 60th day after purchase from CVN Technologies Inc.
Service Under the Warranty
Within the Warranty Period, CVN Technologies Inc. may, at its sole discretion:
- Repair the Product with new or refurbished parts;
- Replace the Product entirely with a new or refurbished Product at no additional charge;
- Replace defective parts that meet the performance specifications of new parts; or
- Provide store credit towards purchase of a new Product.
All exchanged or substituted parts and Products replaced under warranty service will become the property of CVN Technologies Inc. Repaired or replaced Products will be warranted for the balance of the original Warranty Period or sixty (60) days from the date of warranty service, whichever is longer.
Limitations of the Warranty
CVN Technologies Inc.'s obligation to the consumer is limited to the repair, replacement, or store credit of any defective Product or parts. This warranty is only valid for Products purchased and used in Canada. The warranty is not applicable to any purchase for commercial use.
The warranty shall be rendered null and void for each of the following reasons, without limitation:
- Products requiring maintenance due to normal wear and tear, corrosion, rust, age, or improper use;
- Products where the model or serial number has been removed, altered, or rendered illegible;
- Products damaged by unauthorized modifications or repairs;
- LCD or display damage attributable to mishandling, drops, spills, or extreme temperature;
- Cosmetic damages including scratches, cracks, stains, and dents;
- Products damaged from third-party products, acts of nature, or irregular current/voltage;
- Products for which no Proof of Purchase exists or the Warranty Period has expired;
- Products not purchased from CVN Technologies Inc.
Warranty Disclaimers & Limitations of Remedies
CONSUMER'S SOLE AND EXCLUSIVE REMEDY UNDER THIS WARRANTY SHALL BE AS PROVIDED BY THE PROVISIONS, TERMS AND CONDITIONS HEREOF. NONE OF CVN TECHNOLOGIES INC., ITS SUBSIDIARIES, AFFILIATES, AUTHORIZED DISTRIBUTORS OR SERVICE PROVIDERS SHALL BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM PROVINCE TO PROVINCE.
The parties have requested that this contract and all related documents be drawn up in English only.
Warranty Claim Process
During the Warranty Period, if the Product qualifies for service or replacement, contact customer service at (226) 641-6838 or contact us online. Any replaced defective parts will not extend the term of this warranty.
This warranty applies to customers residing in Canada and is governed by the laws of the Province of Ontario.
NOTHING IN THIS WARRANTY LIMITS, OVERRIDES, OR EXCLUDES ANY NON-WAIVABLE STATUTORY RIGHT YOU MAY HAVE AS A CONSUMER UNDER THE CONSUMER PROTECTION ACT, 2002 (ONTARIO) OR THE SALE OF GOODS ACT (ONTARIO). WHERE ANY PROVISION OF THIS WARRANTY IS PROHIBITED BY SUCH LAW, THAT PROVISION APPLIES ONLY TO THE EXTENT PERMITTED.
1. Scope of This Warranty
This Limited New Product Warranty ("Warranty") is provided by CVN Technologies Inc. ("CVN", "we", "us") to the original retail purchaser ("you") of a new product purchased directly from CVN ("Product"). It applies only to new Products purchased and used in Canada for personal, non-commercial use. A valid Proof of Purchase is required for any claim.
2. Manufacturer's Warranty
New Products are covered first and foremost by the original manufacturer's warranty, where one is offered. The manufacturer's warranty terms, duration, and claim procedures govern those claims, and CVN will reasonably assist you in facilitating a manufacturer warranty claim. CVN is not the manufacturer and does not assume the obligations of the manufacturer except as expressly stated in Section 3 below.
3. CVN Limited Warranty
In addition to any manufacturer's warranty, CVN warrants that, at the time of delivery, the Product will be free from defects in materials and workmanship attributable to CVN. The CVN Warranty Period commences on the date of purchase and continues for ninety (90) days, unless a longer period is stated in writing on your Proof of Purchase or is required by applicable law.
4. Service Under This Warranty
If a Product is found by CVN to be defective within the applicable Warranty Period, CVN will, at its sole and reasonable discretion:
- Repair the Product using new, equivalent, or refurbished parts;
- Replace the Product with an identical or comparable new or refurbished product; or
- Refund or provide store credit for the purchase price of the Product.
Any replaced part or Product becomes the property of CVN. A repaired or replaced Product is warranted for the remainder of the original Warranty Period only. Warranty service does not renew or extend the Warranty Period.
5. Exclusions — What Is Not Covered
This Warranty does not apply, and CVN bears no responsibility, where the defect or damage results from any of the following (without limitation):
- Normal wear and tear, consumable parts, gradual deterioration, or cosmetic damage (scratches, dents, cracks, discolouration) that does not affect function;
- Accident, misuse, abuse, neglect, drops, spills, liquid or moisture exposure, fire, or extreme temperature;
- Power surges, irregular voltage, lightning, or other acts of nature;
- Unauthorized repair, modification, or service performed by anyone other than CVN or the manufacturer;
- Use of the Product outside the manufacturer's published specifications, or with incompatible third-party hardware, software, or accessories;
- Software, operating-system, virus, malware, configuration, or data issues not caused by a hardware defect;
- Products where the serial number or identifying labels have been removed, altered, or rendered illegible;
- Products purchased for commercial, rental, or resale use, or used for such purposes;
- Any Product without valid Proof of Purchase, or after the Warranty Period has expired.
6. Your Responsibility to Back Up Data
You are solely responsible for backing up your software and data before submitting any Product for warranty service. Warranty service may require resetting, reformatting, or replacing storage, which can result in the loss of all data. CVN is not responsible for any loss, corruption, or disclosure of data, software, or programs.
7. Limitation of Liability
To the fullest extent permitted by applicable law, your sole and exclusive remedy under this Warranty is the repair, replacement, refund, or store credit described in Section 4. To the fullest extent permitted by law:
- CVN's total aggregate liability arising out of or relating to the Product shall not exceed the amount you actually paid CVN for that Product; and
- CVN shall not be liable for any indirect, incidental, special, consequential, punitive, or economic loss or damage, including loss of data, loss of use, loss of profits, or business interruption, even if advised of the possibility of such damages.
8. Your Statutory Rights
This Warranty is in addition to, and does not affect, any rights you may have under the Consumer Protection Act, 2002 (Ontario), the Sale of Goods Act (Ontario), or other applicable consumer-protection legislation. Some of those rights cannot be limited or waived; where that is the case, the limitations in this Warranty apply only to the extent permitted by law. If any provision of this Warranty is found unenforceable, the remaining provisions continue in full force and effect.
9. Governing Law
This Warranty is governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties have requested that this warranty and all related documents be drawn up in English only. 10. How to Make a Claim
To initiate a warranty claim, contact CVN with your Proof of Purchase at (226) 641-6838 or through our contact page before returning any Product. CVN will provide return or service instructions. You are responsible for safely packaging the Product; CVN is not responsible for damage caused by inadequate packaging in transit.
This warranty applies to repair and service work performed by CVN for customers in Canada and is governed by the laws of the Province of Ontario.
NOTHING IN THIS WARRANTY LIMITS OR EXCLUDES ANY NON-WAIVABLE STATUTORY RIGHT YOU MAY HAVE UNDER THE CONSUMER PROTECTION ACT, 2002 (ONTARIO) OR OTHER APPLICABLE LAW. WHERE A PROVISION IS PROHIBITED BY SUCH LAW, IT APPLIES ONLY TO THE EXTENT PERMITTED.
1. Scope of This Warranty
This Limited Service & Repairs Warranty ("Warranty") covers diagnostic, repair, installation, and other technical services ("Services") performed by CVN Technologies Inc. ("CVN", "we", "us"). It applies only to the specific Service described on your work order, invoice, or service receipt, and only to the original customer who paid for the Service. Proof of Service is required for any claim.
2. Workmanship & Parts Warranty Period
CVN warrants its workmanship (labour) on the completed Service to be free from defect for a period of ninety (90) days from the date the Service is completed, unless a different period is stated in writing on your invoice.
Replacement parts supplied and installed by CVN are covered for the warranty period offered by the part's manufacturer or supplier, or ninety (90) days, whichever is shorter. Parts or components supplied by the customer are not warranted by CVN in any respect, including their function, compatibility, or any consequential damage arising from their use.
3. What Is Covered
If the same fault that was the subject of the original Service recurs within the applicable warranty period due to defective CVN workmanship or a defective CVN-supplied part, CVN will, at its sole and reasonable discretion, re-perform the Service or replace the defective part at no additional labour charge for that original repair.
4. Exclusions — What Is Not Covered
This Warranty covers only the specific repair performed. It does not apply, and CVN bears no responsibility, in any of the following cases (without limitation):
- New, different, or unrelated faults, or issues affecting parts or systems not included in the original Service;
- Pre-existing conditions, or faults disclosed to you as a risk before the Service;
- Customer-supplied parts, software, or accessories, and any damage arising from them;
- Subsequent accident, misuse, drops, liquid or moisture exposure, power surges, or tampering occurring after the device leaves our premises;
- Repair, modification, or servicing of the same device by you or any third party after our Service;
- Software, operating-system, virus, malware, data, or configuration issues, and any intermittent fault that cannot be reproduced ("no fault found");
- Devices with pre-existing physical or liquid damage, which may fail further during or after necessary repair despite our reasonable care;
- Cosmetic wear, and the natural reduction in performance of consumable components such as batteries.
5. Diagnostics, Estimates & Authorization
Services are performed only with your authorization. Where a diagnostic fee applies, it will be disclosed in advance. We will provide an estimate before proceeding with chargeable work; the final cost may vary where additional faults are discovered, in which case we will seek your approval. Under our no-fix, no-fee approach you do not pay the repair charge for a repair we are unable to complete, though a disclosed diagnostic fee may still apply.
6. Data Backup & Data Loss
You are solely responsible for backing up all data and software before submitting any device for Service. Many repairs — including operating-system, storage, and board-level work — carry an inherent risk of data loss, and some require erasing or replacing storage. CVN is not liable for any loss, corruption, or disclosure of data, software, or programs, however caused. A backup or data-transfer service is available on request before work begins.
7. Device Collection & Uncollected Property
You agree to collect your device promptly once Service is complete. Devices left with CVN for more than sixty (60) days after we notify you that they are ready, or after a quote is declined, may be treated as abandoned and may be disposed of, recycled, or sold to recover unpaid charges and storage costs, to the extent permitted by applicable law. Storage fees may apply.
8. Limitation of Liability
To the fullest extent permitted by applicable law, your sole and exclusive remedy under this Warranty is the re-performance of the Service or replacement of the defective CVN-supplied part as described in Section 3. To the fullest extent permitted by law:
- CVN's total aggregate liability arising out of or relating to any Service shall not exceed the amount you actually paid CVN for that Service;
- CVN shall not be liable for any indirect, incidental, special, consequential, punitive, or economic loss or damage, including loss of data, loss of use, loss of profits, or business interruption, even if advised of the possibility of such damages; and
- CVN is not liable for the failure of pre-existing components, or for damage that was unavoidable in carrying out a necessary repair on an already-damaged device.
9. Your Statutory Rights
This Warranty is in addition to, and does not affect, any rights you may have under the Consumer Protection Act, 2002 (Ontario), the Sale of Goods Act (Ontario), or other applicable consumer-protection legislation. Certain of those rights cannot be limited or waived; where that is the case, the limitations in this Warranty apply only to the extent permitted by law. If any provision of this Warranty is held unenforceable, the remaining provisions continue in full force and effect.
